Bail Agent Form

Pursuant to Santa Clara County Board of Supervisors Policy 3.60​, bail agents and criminal defense attorneys who have an office in and do business in Santa Clara County may submit a request to have their information posted in County jail facilities.  

To request a listing, complete this form by Tuesday, December 15, 2020. All applicable questions must be answered, and only complete forms will be considered. 

PLEASE NOTE: A bail bond agent, company, or attorney/law firm is limited to one listing.  Multiple listings from bail agents or attorneys affiliated with the same company/firm are not permitted.  Individuals using the same phone number or address, or included as endorsed agents with a company/firm’s California Department of Insurance Bail Agent Corporation License, are presumed to be affiliated with the same company/firm.  Individuals who are sole proprietors of multiple companies/firms may submit only one request.​​​

Bail Board Posting Application

1. Check one:

* This must be either a legally recognized name, such as a given name, a registered “DBA” name, or a corporation name. Of these options, provide preferred name exactly as it should appear on the posting.

* For companies/firms with multiple agents/attorneys, provide name of agent/attorney submitting this form. For sole proprietors, this may be the same name provided for #2.

10. Check the languages in which business is conducted. The bail agent/company or attorney/law firm must be able to transact bail or provide legal services in Santa Clara County in all languages checked.

If you check 'Other' on above question, please specify.

11. Please answer either subsection (a) or (b).

(a). For Bail Bond Companies and Bail Agents:

Has the California Department of Insurance taken any final enforcement or disciplinary action against the bail bond company, any bail agent authorized to transact on behalf of the bail bond company in Santa Clara County, or any employee of the bail bond company in Santa Clara County, within the past five years?
*Do NOT limit your answer to final enforcement or disciplinary actions involving events in Santa Clara County.
Have any justified complaints against the bail bond company, any bail agent authorized to transact on behalf of the bail bond company in Santa Clara County, or any employee of the bail bond company in Santa Clara County, been filed with the California Department of Insurance within the past five years?
*Do NOT limit your answer to justified complaints involving events in Santa Clara County.
Has the bail bond company, any bail agent authorized to transact on behalf of the bail bond company in Santa Clara County, or any employee of the bail bond company in Santa Clara County, been convicted in California within the past five years of any offense related to bail bonds or the transaction of bail?
*Do NOT limit your answer to convictions involving events in Santa Clara County.

(b). For Law Firms and Attorneys:

Has any attorney in the law firm who practices in Santa Clara County been disciplined by the State Bar of California within the past five years?
*Do NOT limit your answer to discipline involving events in Santa Clara County.
Has any attorney in the law firm who practices in Santa Clara County been convicted in California within the past five years of any offense related to the provision of legal services?
*Do NOT limit your answer to convictions involving events in Santa Clara County.

12. Certifications

Pursuant to Board of Supervisors Policy 3.60, any bail agent or attorney requesting to have information posted in County jail facilities must certify the information listed below under penalty of perjury. Any certification that is false or misleading, in whole or in part, will result in removal of the bail agent or attorney's information from County jail facilities; denial of the bail agent’s or attorney’s request to have information posted at the next annual posting of information; and/or a requirement that the bail agent or attorney submit documentation to verify the information provided in subsequent requests. Repeated or serious violations of the certification requirement or of Board Policy 3.60 may result in disqualification from all future postings.

By electronically signing and submitting this form, I certify the following, under penalty of perjury under the laws of the State of California:

  1. The information provided on this form is true and correct.
  2. For bail bond companies/bail agents: The bail bond company and all individuals acting as bail agents or transacting bail on its behalf in Santa Clara County have an active bail agent license issued by the California Department of Insurance. ​For law firms/attorneys : All attorneys practicing law in Santa Clara County on behalf of the law firm are active members of and in good standing with the State Bar of California.
  3. In providing bail or legal services in Santa Clara County, the bail bond company/law firm and its bail agents, attorneys, and employees comply with all applicable state, federal, and local laws rules, and regulations.
  4. The bail bond company or law firm is in compliance with all applicable local licensing or permitting requirements.
  5. Bail agents or criminal defense attorneys employed by the bail bond company/law firm conduct business out of a physical office located in Santa Clara County.
  6. The local phone number provided on this form connects the caller with the bail bond company’s or law firm’s physical office in Santa Clara County.
